Saw this on Kotaku, looks absurd, lots of content and the classic remake of SMB3 using the New Super Mario Bros engine.

I love and hate seeing this sort of stuff. The hate is more linked to disappointment, because of the inevitable legal situation which is going to disappoint people (it infringes on patents and copyrights). Love because it's awesome that someone would do this.
Seems Nintendo's legal team didn't get to destroy it before it was made public, and now we have glorious hacked SMB3.

Nintendo usually allows fan projects to remain public as long as long as they can before they are legally obligated to protect their patents. It's not like Nintendo is "out to destroy" fan made material, it is their legal obligation to protect their patents - otherwise they lose the patents associated with their flagship franchise.

Videogames are protected by copyright, not patents. Patents can be lost by not protecting them, but copyright cannot. (There are rare occurrences of a patents being granted for gameplay innovations, but I can literally only think of one: the sanity meter in Eternal Darkness.)
I went ahead and uploaded it separately for those of your interested so you don't have to go through all the patching and junk.
You still need an R4 or Nintendo DS Emulator(DeSmuME or NO$GBA) to play it though.

This stuff seems more like map packs than a real game. There's obviously a lot of custom Mario levels out there in Japan and I'd guess if they're not selling these it's not a big deal people are making their own maps.

Yup, Mario and company probably have trademark protection because they are so closely associated with Nintendo.

Nintendo allowed the Mother 3 translation to go through (you can even buy the fan-made guide still), same with AM2R which is getting nearly a completed and not a peep from them and that Zelda Solaris game. The only thing I can remember them pulling is that fan-made Zelda flick that came out. They've always been pretty good about things like that, better than most.

There's an entire convention dedicated to Nintendo fangames, it's not that bad. ;p
