And actually, downloading is something that isn't prosecuted...whether it's legal to download movies/games/music/etc is still a very "ify" issue. Hell, in Canada it's actually legal download.
What is illegal, however, is sharing/uploading. If they can trace you, you are at risk.
Truth is, if you don't know what you are doing (ie: scanning/rooting), you should not attempt to share shit...to do so makes you a dumbass.
That said, bittorrent is relatively safe, especially since you can hack any prog to remove the upload. There are other methods too (NGs, IRC, servers)....explore at your discretion.
Nothing is 100% safe....except making sure you share nothing.
PS - Remove Kazaa. You shouldn't even have it installed unless you dig downloading virus infested kiddy porn.
